JFI 123 inc. (DBA Johnny Fix It, DBA JFI Contracting)

- Agreement
These Terms & Conditions (“Agreement”) apply to all proposals, estimates, and services provided by JFI 123 Contracting (“Contractor,” “we,” “us,” or “our”). Acceptance of any estimate, proposal, or invoice constitutes acceptance of these Terms.
- Scope of Work
All work will be performed as outlined in the approved estimate or proposal. Any work not specifically listed is excluded.
Changes to Scope (Change Orders)
- Any additional or modified work must be approved in writing.
- Change Orders may affect cost and timeline.
- Verbal requests are not binding unless documented.
- Pricing & Payments
3.1 Payment Terms
- Deposit may be required prior to scheduling.
- Progress payments may be required depending on project size.
- Final payment is due upon substantial completion unless otherwise agreed.
3.2 Late Payments
- Late payments may be subject to interest charges.
- Contractor reserves the right to pause work until payment is current.
3.3 Non-Payment
- Customer agrees to pay all reasonable collection costs, including legal fees if necessary.
- Estimates & Proposal Validity
- Estimates are valid for 30 days unless otherwise stated.
- Pricing may change due to:
- Material cost increases
- Labor changes
- Scope modifications
- Permits & Approvals
- Permits will be handled as outlined in the proposal.
- If permits are required:
- Additional costs and time may apply.
- Customer is responsible for HOA approvals unless otherwise specified.
- Plans & Specifications
- If architectural or engineered plans are required:
- Final pricing is subject to review of stamped plans.
- Contractor is not responsible for design errors in third-party plans.
- Scheduling & Delays
7.1 Scheduling
- Project start dates are estimates and may change based on:
- Weather
- Material availability
- Scheduling conflicts
7.2 Delays
Contractor is not liable for delays caused by:
- Weather conditions
- Supply chain issues
- Permit delays
- Unforeseen site conditions
- Site Conditions & Access
- Customer agrees to provide safe and reasonable access to the work area.
- Contractor is not responsible for:
- Pre-existing conditions
- Hidden damage or code issues discovered during work
Additional work required due to unforeseen conditions will be handled via Change Order.
- Subcontractors
- Contractor may use qualified subcontractors to perform portions of the work.
- Contractor remains responsible for overall project completion.
- Materials
- Material selections must be finalized prior to ordering.
- Delays in selections may delay project timeline.
- Contractor is not responsible for manufacturer defects.
- Cleanup & Job Site
- Contractor will maintain a reasonably clean job site.
- Final cleanup will be performed upon project completion.
- Customer is responsible for securing valuables and personal items.
- Warranties
12.1 Workmanship Warranty
- Contractor provides a limited workmanship warranty of [Insert Timeframe].
12.2 Manufacturer Warranties
- Materials may carry separate manufacturer warranties.
12.3 Warranty Exclusions
Warranty does not cover:
- Normal wear and tear
- Customer misuse or neglect
- Damage caused by others
- Insurance & Licensing
- Contractor is licensed and insured in Rockland County, Westchester County, and New Jersey.
- Proof of insurance available upon request.
- Liability
- Contractor is not liable for indirect or consequential damages.
- Liability is limited to the value of the contracted work.
- Right to Stop Work
Contractor reserves the right to stop work if:
- Payments are not made as agreed
- Site conditions are unsafe
- Customer breaches this Agreement
- Cancellation
- Customer may cancel prior to work starting; deposit may be non-refundable.
- Cancellation after work begins may result in charges for:
- Work completed
- Materials ordered
- Lost scheduling time
- Dispute Resolution
- Both parties agree to attempt good-faith resolution.
- If unresolved, disputes may be subject to mediation or legal action in the appropriate jurisdiction.
- Photography & Marketing
- Contractor may take photos of the project before, during, and after completion.
- Photos may be used for marketing purposes unless the customer requests otherwise in writing.
- Communication
- Customer agrees to maintain clear and timely communication.
- All key decisions must be documented in writing (email, Jobber, or signed document).
- Entire Agreement
This Agreement, along with the approved proposal and any Change Orders, constitutes the entire agreement between the parties.
- Acceptance
By approving an estimate, signing a proposal, or making payment, the Customer acknowledges and agrees to these Terms & Conditions.
